1 As the Confederation's funding body for science-based innovation as defined in the Federal Act of 17 June 201632 on the Swiss Innovation Agency, Innosuisse may fund innovation projects that are carried out by higher education research centres and non-commercial research centres outside the higher education sector (research partners) with private or public partners, which are responsible for exploiting the results (implementation partners).33
1bis The contribution from Innosuisse shall be used to cover the direct project costs incurred by the research partners. Innosuisse may in its Funding Ordinance provide that contributions are also paid to implementation partners, if this is required for international cooperation in the field of science-based innovation.34
2 Contributions shall only be granted if the following requirements are fulfilled:

- b.
- effective implementation of the research findings in favour of the economy and society may be expected;
- c.
- the project could probably not be carried out without the Confederation's support;
- d.36
- the implementation partners participate in the project by means of their own contributions or contributions to the research partners amounting to 40-60 per cent of the direct overall project costs;
- e.
- the project contributes to the practice-oriented training of young researchers.
2bis Innosuisse may in individual cases demand a smaller participation than 40 per cent from the implementation partners, provided any one of the following requirements is met:
- a.
- The project has above-average realisation risks but at the same time the potential for above-average economic success or a high social benefit.
- b.
- The anticipated results have the potential to benefit not only the implementation partners, but also a broad group of users who are not participants in the project.
- c.
- The implementation partner lacks the financial resources at the time that the contribution is granted to contribute to the project to the extent demanded, but has an above-average potential for implementing the project results successfully.
- d.
- The project will be carried out as part of a time-limited special programme in accordance with Article 7 paragraph 3.37
2ter It may in individual cases demand a higher participation than 60 per cent from the implementation partners provided any one of the following requirements is met:
- a.
- The project has lower realisation risks and at the same time an above-average potential for economic success for the implementation partner.
- b.
- The economic capacity of the implementation partner or the characteristics of the project justify a higher participation, especially if the implementation partner does not finance part of its participation itself due to other support.38
3 It may support innovation projects which are being pursued by research partners without implementation partners, provided the projects offer significant but not yet sufficiently specific innovation potential.39
3bis It may support the innovation projects of start-ups, if the project requires preparatory work for first-time market entry. Innosuisse's contribution may be used to partially or fully cover both the start-up's own direct project costs and the costs for third-party services. Innosuisse shall specify the eligibility criteria and the criteria for determining the amount of the start-up's own contributions in its Funding Ordinance. In particular, it shall take into account the criteria specified in paragraphs 2bis and 2ter.40
3ter Where Swiss companies are denied access to European Commission funding opportunities for individual projects, Innosuisse may support projects with significant innovation potential from start-ups and small and medium-sized enterprises that target rapid and efficient commercialisation and corresponding growth. Innosuisse's contribution may be used to partially or fully cover both the company's own direct project costs and the costs for third-party services. Innosuisse shall specify the eligibility criteria and the criteria for determining the amount of the companies' own contributions in its Funding Ordinance.41
4 It may in addition provide for instruments to subsidise the costs of studies to determine the effectiveness and feasibility of projects carried out by companies.42
5 In particular, it shall fund projects under paragraphs 1 3, 3bis, 3ter and 4 which make a contribution to the sustainable use of resources.43
6 The projects that receive funding must follow the principles of scientific integrity and good scientific practice. If this is not the case, the sanctions and the duty to provide information under Article 12 paragraphs 2-4 apply.
