1 Providers of services of the universal service are responsible for the collection of directory information from their customers and are alone entitled to amend the data at the request of subscribers. They are not obliged to review the accuracy of the data but must guarantee that it corresponds to the information provided by customers. They may refuse to include an entry in the directory if it is clearly inaccurate or if it serves an unlawful purpose, and they may remove such entries from the directory.
2 They are obliged to provide those entitled in accordance with Article 21 paragraphs 2 and 3 TCA both online access to directory data pertaining to their customers and the transmission of data en bloc, with the option of at least daily updates. In so doing, they may bill costs incurred exclusively by the provision of data in compliance with Article 54.
2bis Subject to the same conditions as in paragraph 2, they shall enable the providers of a service for establishing communications to customers who are not entered in the directory but who have given their consent to be contacted within the framework of such a service to access the following data:
- a.
- the last name and first name or the company name of the customer;
- b.
- the address in full;
- c.
- the addressing resource by means of which the customer can be contacted.32
2ter They shall inform their customers clearly and explicitly that if they have given their consent to be contacted within the framework of a communication establishment service, the data mentioned in paragraph 2bis must be forwarded to any provider of such a service that requests it.33
3 They may call in third parties within the framework of a contractual relationship to fulfil their obligations under paragraphs 1, 2 and 2bis.34
4 The integrity of directory data received in accordance with paragraph 2 and 2bis must be preserved; it may under no circumstances undergo changes in content.35
4bis Providers which have access to the data mentioned in paragraph 2bis may process this data only in order to provide a service for establishing communications. In particular, they shall not publish it, use it for advertising purposes or disclose it to third parties.36
5 OFCOM shall issue the technical and administrative regulations.
